OFFICIAL 2007 VIKING DESIGNERS OF DISTINCTION EVENT RULES

SPONSOR: The 2007 Viking Designers
of Distinction event (the “Event”) is
sponsored by Viking Range Corporation (referred to in these
Official Rules as the “Sponsor”).
ELIGIBILITY: The Event is offered
only in the United States of America to legal residents
thereof, 18 years of age or older, who are engaged in the
business of designing residential kitchens which utilize
Viking appliances, except for employees (and the immediate
families and members of the same household of such employees)
of the Sponsor and the Sponsor’s subsidiaries, who may
not enter. Eligible individuals are referred to in these
Official Rules as “Designers.” Immediate
family is defined as a parent, sibling, a child or a spouse of
the employee. Void where prohibited by law. Entries from
non-residents of the United States of America are ineligible.
EVENT PERIOD/DEADLINE: The Event
begins at 9:00 a.m. Central Time on May 10, 2007 and ends at
5:00 p.m. Central Time on October 31, 2007 (the
ldquo;Event Period”). No entries will be received
before the start of the Event Period. All entries must be
received by the Sponsor by 5:00 p.m. Central Time on October
31, 2007.
HOW TO ENTER: Here are the ways to
enter the Event:
1) By Internet – Registration
Part of Event: Click here to
Register. Fill in and submit the Event registration
form to become eligible to win the Sponsor’s monthly
Viking prizes. Designers must correctly, truthfully and fully
answer all questions on the registration form in order to be
eligible to win any Event prizes. Designers will receive a
registration confirmation in connection with their valid
registration. Designers may only register once –
multiple registrations by the same Designer may result in
ineligibility to receive the Event’s prizes at the
Sponsor’s discretion. The foregoing registration process
is referred to as the “Internet Registration”
part of the Event.
2) By Internet – Photo Submission
Part of Event: After registering on the Sponsor’s
website as provided above, Designers may also submit photo
entries to be considered for photo submission prizes.
Photographs must be owned and taken by or on behalf of the
Designer, must not infringe upon any third party’s
intellectual property rights (
e.g., the photo may not have been previously published
in a magazine or other copyrighted work in which the Designer
did not retain rights of ownership over the photo), and must
clearly depict one or more Viking appliances. Submission by a
Designer of a photograph constitutes the Designer’s
affirmation and warranty to the Sponsor that: (a) the
photograph is the Designer’s sole, exclusive and
original work and that there exists no adverse claim in and to
the photograph by another party; (b) the Designer has not
previously sold, transferred or licensed the photograph to any
other person, and (c) submission of the photograph to the
Sponsor and use by the Sponsor of such photograph does not
infringe upon any other party’s intellectual property
rights. The submitting Designer promises to indemnify and hold
the Sponsor harmless from any claims and damages resulting
from any breach of the foregoing warranty. Photographs may
only be submitted during the Event Period as e-mail
attachments addressed to
esignerphotos@vikingrange.com and must be in a JPEG or PDF
format no larger than 3MB. Designers must submit any and all
photos from the e-mail address previously entered and
confirmed during Internet Registration or specify a change of
e-mail address in the subject line of the e-mail. Multiple
photo entries by the same Designer are permitted. The
foregoing photo submission process is referred to as the
ldquo;Photo Submission” part of the Event.
No correspondence or contact other than
that specified in these Official Rules will be accepted as an
entry in the Event. All entry information becomes the property
of the Sponsor. Designers retain all ownership rights to
their submitted photographs except for the license granted to
the Sponsor described below.
HOW THE EVENT WORKS/PRIZES AND PRIZE
WINNERS SELECTION:
1) Monthly Internet Registration
Prizes: Those Designers who completely satisfy the entry
conditions set forth above for the Internet Registration part
of the Event will be eligible to win one of the following
non-cash prizes: (a) Viking 5 qt. stand mixer (approximate
retail value $400.00), (b) Viking blender (approximate retail
value $140.00), (c) Viking food processor (approximate retail
value $300.00), (d) Viking toaster (approximate retail value
$300.00), (e) 7 piece Viking cookware set (approximate retail
value $540.00), and (f) 9 piece Viking chef’s cutlery
set with maple knife block (approximate retail value $640.00).
From such Designers, one or more individuals will be awarded
the prize or prizes specified as being awarded on a randomly
selected basis on the last day of each month during the Event
Period by the Sponsor. Throughout the entire Event Period,
some combination of the above described prizes will be awarded
to randomly selected Designers with an aggregate –
approximate retail value of $2,320.00. Once a Designer has
completed the Internet Registration part of the Event, the
Designer will be eligible to participate in the drawing that
occurs in the month of such Internet Registration and each
following month that awards are made during the Event Period.
The Sponsor shall announce the winners of the Internet
Registration Prizes by e-mailing the winning Designers. The
Sponsor reserves the right to announce the identity of each
Internet Registration prize winner and the prize awarded to
such winner on its website.
2) Quarterly Photo Submission Prizes:
Those Designers who satisfy the entry conditions set forth
above for the Internet Registration part of the Event and
also participate in the Photo Submission part of the Event
will be eligible to be selected as a Photo Submission prize
winner. Each winning Designer and his or her winning
photograph shall be selected by the Sponsor’s personnel
based upon the perceived merits of the photograph, including
the artistic value of the photograph, the favorable manner in
which the photograph portrays the Viking appliance depicted,
or such other factors and elements, all as determined by the
Sponsor in its sole and absolute discretion. On August 1,
2007, the Sponsor shall select the winning photograph/Designer
from photographs submitted on or before such date (other than
the photographs submitted by the Designer previously awarded
the Photo Submission/Featured Designer Prize) for the October
through December, 2007 quarter. Such winning Designer shall be
the quarterly “Featured Designer” on the
Sponsor’s website during the October through December,
2007 quarterly period. The Sponsor shall announce the winners
of the Photo Submission prizes by e-mailing the winning
Designers and posting details concerning the winners on the
Sponsor’s website.
3) Grand Prize: On November
4, 2007, the Sponsor shall select a single winning
photograph/Designer for the Event’s Grand Prize from
photographs submitted on or before the end of the Event Period
(which may include the photographs submitted by all the
Designers previously awarded the Photo Submission/Featured
Designer prizes). The criteria used to select the Grand Prize
winner shall be the same as those used in selecting the
quarterly Photo Submission/Featured Designer prizes. The Grand
Prize winner’s photo will be designated the “2007
Viking Featured Designer” and the photo and winner will
be featured on the “Trade Professional” portion
of the Sponsor’s website during the calendar year 2007.
The Grand Prize winner will also receive a free trip to the
2007 Luxury Kitchen and Bath Collection in Miami, Florida held
on December 7-9 of 2007 (entry fee to conference for one
person to be paid by the Sponsor, round-trip airfare and
accommodation for one person for three nights to be paid for
and selected by the Sponsor – approximate retail value
$1,800.00). During the conference, the Sponsor will host a
dinner in the Grand Prize winner’s honor (approximate
retail value $200.00). The Grand Prize also includes a second
trip for two people to Miami, Florida, including first class
round-trip airfare to Miami from the winner’s home town
within the United States, a three night stay at a luxury hotel
in South Beach, Miami, first class round-trip airfare from
Miami, Florida to St. Thomas, United States Virgin Islands,
and a three night stay at a luxury hotel in St. Thomas
(approximate aggregate retail value $10,000.00). Travel to and
from Miami / St. Thomas must be completed by June 30, 2008.
The Sponsor shall announce the winner of the Grand Prize by
e-mailing the winning Designer and posting details concerning
the winner on the Sponsor’s Website.
All drawings will be conducted by the
Sponsor at its headquarters in Greenwood, Mississippi. All
prize winners will also be notified by certified mail. Within
14 days of the date of the notice by certified mail, each
prize winner will be required to execute and return an
Affidavit of Eligibility and Liability Release and, where
legal, a Publicity Release. Failure to comply with this
requirement will cause the prize to be forfeited and awarded
to an alternate winner. All prize winners who comply with
these Official Rules shall receive such prizes no later than 8
weeks after the end of the Event Period. Except where
prohibited by law, acceptance of a prize shall constitute and
signify the winner’s consent that the Sponsor may use
the winner’s name, likeness, image, voice, photographs,
biographical information and address (city and state), and
written statements made by the winner about the Event and
Sponsor, in all forms of media, in perpetuity, for promotional
purposes without payment or consideration.
If a prize notification letter is returned
or deemed undeliverable, or if the winner is found to be
ineligible or fails to comply with these Official Rules, the
Sponsor may determine that the winner has forfeited the prize
and an alternate winner of that prize will be selected from
eligible Designers for the prize.
ODDS OF WINNING: The odds of
winning any prize depends on the number of valid entries
received and the number of Designers who qualify by completing
the Internet Registration process, as well as the number of
Designers who also submit photos in connection with the Photo
Submission part of the Event and the quality of the photos
submitted.
TRANSFERABILITY/TAXES: All prizes
are non-transferable and are not exchangeable for cash;
provided, however, that the Sponsor may in its discretion
offer to prize winners the option of receiving a cash prize
substitute. All prize winners will be solely responsible for
all taxes (federal, state and/or local) and any expenses not
specified related to acceptance and use of the prize.
CONDITIONS: The Sponsor is not
responsible for errors, omissions, interruptions, deletions,
defects, delays in operations or transmissions, theft or
destruction or unauthorized access to or alterations of entry
materials, or for technical, network, telephone, computer,
hardware or software malfunctions of any kind, or inaccurate
transmissions of, or failure of the Sponsor to receive entry
information on account of human or technical problems in any
combination thereof. The Sponsor reserves the right, in its
sole discretion, to cancel the Event in its entirety if it
becomes technically corrupted or because of non-authorized
human intervention. The Event is subject to these Official
Rules. By entering, participants (a) agree to these Official
Rules, the decisions of the Sponsor, which shall be final and
binding in all respects, and waive any right to claim
ambiguity in the Event or these Official Rules; (b) release
the Sponsor, its directors, officers, employees, divisions,
subsidiaries, affiliates, and advertising and promotion
agencies, and such entities’ respective directors,
officers and employees from any and all liability for any
injuries, losses or damages of any kind caused by their
participation or resulting from acceptance, possession, use,
or misuse of the prizes; and (c) acknowledge that the Sponsor
and other released entities and individuals have neither made,
nor are in any manner responsible or liable for any warranty,
representation, or guarantee, expressed or implied, in fact
or in law, relative to the prizes including, but not limited
to, their quality, mechanical condition, or fitness, except
for any standard limited warranty offered by any manufacturer
of the non-cash prizes. The Sponsor may prohibit an entrant
from participating in the Event or winning any prize if in its
sole discretion it determines that the entrant is attempting
to undermine the legitimate operation of the Event by
cheating, hacking, deception, or other unfair playing
practices or intending to annoy, abuse, threaten or harass any
other participants or the Sponsor’s representatives.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE
THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE
LEGITIMATE OPERATION OF THE EVENT MAY BE IN VIOLATION OF
CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE,
THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES
(INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO
THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL
PROSECUTION.
USE OF REGISTRATION INFORMATION/PHOTOS:
By completing the Event’s Internet Registration
forms, the entrant grants the Sponsor the right to use the
information provided on the forms, and contact the entrant by
email, telephone, mail or fax. By submitting photographs in
connection with the Photo Submission part of the Event, each
such Designer grants the Sponsor a non-exclusive right to use,
reproduce, print, publish, disseminate and publicly display
the submitted photograph in connection with the promotion,
marketing and sale of the Sponsor’s products. Such
license shall be perpetual, worldwide, transferable and
royalty-free.
WINNERS LIST/RULES: For a copy of
the Official Rules, mail a stamped, self-addressed envelope on
or before March 31, 2007 to:
